2011 Herald Foundation Car/Cash Raffle Rules
The Herald Foundation is incorporated as a nonprofit corporation under the laws of the State of Ohio for the primary purpose of supporting Saints John & Paul School in Ashtabula, Ohio. The 2011 Herald Foundation Car/Cash Raffle ("Raffle") is conducted for the purpose of generating funds to support the activities of Saints John & Paul School.
1. ELIGIBILITY.
Each entrant, by entering the Raffle, agrees to abide by all of the rules and conditions contained herein, as well as all applicable local, state and federal laws and regulations, and further agrees to release the Herald Foundation and Saints John & Paul School and its directors, officers, agents and employees from any and all liability with respect to all aspects of the Raffle including, but not limited to, the selection process. The Raffle is open to any eligible person residing in a country or state where the Raffle is not prohibited. Entrants must be 18 years of age or older.
2. TICKET PURCHASE.
The cost to purchase a single entry ticket ("ticket") for the raffle is $100.00 (U.S. Funds only) and is not tax deductible. Any entrant may purchase more than one ticket. More than one name may be listed on a ticket, but the first name listed shall be deemed to be the entrant. An entrant can enter the Raffle by purchasing a ticket over the Internet from our secure Website located at www.ssjpfundraiser.org, by calling Saints John & Paul High School at (440) 997-5531 or in person at either school office located at 541 West 34th Street or 2150 Columbus Avenue, both of which are located in Ashtabula, Ohio during school hours. Tickets may also be sold at school functions and events. Ticket payment can be made by VISA Bankcard, MasterCard, check, money order or cash. Please do not send cash in the U.S. Mail. If an entrant's payment is dishonored by the bank for any reason, such entrant's ticket will be declared invalid unless full and satisfactory payment is made prior to the Raffle drawing. Any dishonored credit card will be considered an invalid entry. Completed tickets must be in the possession of the Herald Foundation by the time of the drawing to be eligible for the Grand Prize drawing. Any tickets and payments (including payments previously dishonored) received after closure of the Raffle will be returned to the entrant. Upon receipt of a completed ticket and valid payment, the ticket with assigned drawing number will be entered into the raffle.
3. PRIZES.
GRAND PRIZE.
The Grand Prize is the Grand Prize winner's choice of a $15,000.00 cash prize OR up to $25,000.00 towards the purchase of a new vehicle at either Great Lakes Auto Network or Nassief Automotive.
If the vehicle prize option is chosen, the Grand Prize winner must purchase the vehicle from Great Lakes Auto Network or Nassief Automotive, both of which are located in Ashtabula, Ohio. The winner must negotiate directly with Great Lakes Auto Network or Nassief Automotive for the vehicle of their choice. The Herald Foundation will not act as agent on behalf of the winner in purchasing the vehicle. The winner, at his or her sole expense, may choose to have the vehicle shipped to another location for final delivery. The winner is responsible for making any and all such arrangements. The Herald Foundation will not act as agent on behalf of the winner in arranging final transportation.
SELLER BONUS.
The Seller of the winning ticket receives $2,000.00. The Website is the seller for tickets purchased online.
4. WINNING CHANCES.
Odds of winning depend on the number of eligible entries received. Odds increase by purchasing additional tickets.
5. DRAWINGS.
Winners will be determined by a random drawing of all the eligible tickets received by the entry deadlines. The Drawing will take place on July 10th, 2011.
6. MODIFICATION OR CANCELLATION OF DRAWING.
The Herald Foundation reserves the right to cancel the Raffle if a minimum of 300 tickets are not sold by the date of the drawing.
7. WINNERS.
Winners will be notified by phone, e-mail or by mail based on the information received on the ticket. Winning entrants agree to allow Saints John & Paul School and the Herald Foundation to use their names, likeness, and any statements made by them regarding the prize for advertising or publicity purposes without compensation. Winners may be required to complete and return an affidavit of eligibility and liability release. Failure to do so if requested or if one otherwise fails to comply by these rules and/or to make arrangements to claim his or her prize within thirty (30) days of notification will void that entry.
8. AWARDING OF PRIZES.
More than one name may be listed on a ticket, but the first name listed shall be deemed to be the entrant. A social security number must be provided, and it must be that of the entrant. The Herald Foundation assumes no responsibility for a prize winner's tax obligations and suggests you consult your tax advisor. The Herald Foundation will file a form 1099 with the Internal Revenue Service to report the value of the prize won. The winner will also receive a copy of this form.
If the cash prize is chosen, payment of the $15,000.00 cash prize shall be made in the form of a check solely to the entrant. The winner assumes and must pay all local, state and federal taxes when the cash is transferred to the winner where applicable.
If the vehicle purchase option is chosen, the Herald Foundation will make a check payable to either Great Lakes Auto Network or Nassief Automotive in an amount up to $25,000.00 to be used only towards the purchase of a new vehicle chosen by the winner. The actual dollar amount, not to exceed $25,000.00, will be determined by the dealership the winner chooses to purchase the vehicle from and communicated by the dealership to the Herald Foundation. It is the sole responsibility of the entrant in a multiple party entry to allocate any such prize among the participants in a multiple party entry. The winner assumes and must pay all fees, taxes and charges where applicable (including, but not limited to, tags and license) and local, State and Federal taxes when the car is purchased.
Payment of the Seller Bonus in the amount of $2,000.00 will be made in the form of a check to the person whose name appears as the seller on the winning ticket. The winner assumes and must pay all local, state and federal taxes when the cash is transferred to the winner where applicable.
9. AUTHORITY AND CONTROL.
The decision of the Herald Foundation shall be final in all matters concerning the Raffle. The Raffle is subject to the laws of the State of Ohio. Void where prohibited by law.
